Nissan Rogue Twitter Party Contest (THE “Contest”)
1. NO
PURCHASE NECESSARY: The Contest is sponsored by Nissan
Canada Inc. (“Contest
Sponsor”), 5290 Orbitor Dr, Mississauga, ON.
2. ELIGIBILITY: The Contest is open
to legal residents of Canada, excluding residents of Quebec, who have reached
the age of majority in their province or territory of residence at time of entry and who are not employees of the Contest Sponsor, its affiliated
companies or agents, their respective advertising or promotional agencies, or
the third parties engaged by Contest Sponsor to assist it in administering the Contest
including the independent contest organization or a member of any such
employee’s immediate family (regardless of where they live) or persons whom
they are domiciled (whether related to the employee or not). In these official
rules, “immediate family” includes mother, father, brothers, sisters, sons,
daughters, partner and/or spouse.
This contest is void outside of
Canada and where prohibited by law.
3. CONTEST PERIOD: The Contest begins on February 13, 2014 at 9:00 p.m. Eastern Time (“ET”) and ends on February 13, 2014 at 10:00 p.m. ET (the “Contest
Period”).
4.
HOW TO ENTER: To enter the Contest, please follow these steps:
(a) Registration: Between 8:00 pm on February 10, 2014 and 10:00 pm on February
13, 2014 visit http://www.torontoteachermom.com/2014/02/nissan-rogue-twitter-party.html(the “Contest Website”) and scroll down to the Linky List. Next, click on
the “click here to enter” tab and upon doing so, RSVP by inserting your twitter
handle in the “Link Title Field” and by inserting your twitter link in the
“Link Field”. Next, click “enter” and you will be registered (the “Registration”).
(b) Twitter: To enter the Contest from your Twitter account, you must
follow the Sponsor’s official Twitter account (@NissanCanada) and be registered
on the Contest Website (see rule 4.a).
If you do not have a Twitter account, you will need to create one. Visit www.twitter.com and follow the instructions to
register for a free account. To become a Follower of the Sponsor, you must
access your twitter account and search people for “Nissan Canada” and click the
“Follow” button corresponding to @NissanCanada.
Entrants are subject to Twitter's Terms of Service and Rules; these can
be found at https://twitter.com/tos. Sponsor is not responsible in
any way for any decisions Twitter makes regarding the entrant's account with
Twitter.
During
the Contest Period, “@NissanCanada” will post a total of eight (8) tweets (a “Question”) during the Contest Period
with the hashtag “#NissanRogue”. To
enter the Contest, click reply with your answer to the posed
question with hashtag
“#NissanRogue” and mention “@NissanCanada” (a “Entry”). Your tweet must include the hashtag “#NissanRogue” and must include “@NissanCanada” (a “Mention”) so
that your tweet appears in the Sponsor’s Mentions during the Contest Period. Limit
of one (1) Entry per Question per Twitter Account per Person. Multiple, separate
tweets contributed to each #NissanRogue Question and/or any re-tweets of an
entrant’s tweet will not increase the chances of winning and are not encouraged. Entries must comply with the
Twitter.com terms of use and the Tweeting Format and Content requirements
(detailed in rule five (5)) to be eligible. No other entry method will be accepted. By tweeting an answer to each
Question, you will automatically receive one (1) Entry into the Contest up to a
maximum of eight (8) Entries.
Anyone found to use multiple
accounts to enter the Contest will be ineligible. Use of any automated, script, macro, robotic or other
program(s) to enter or otherwise participate in this Contest is prohibited and
will automatically result in disqualification. In the
event an
entrant tweets inappropriate content, in the sole discretion of the Sponsor, he
or she will be disqualified. Anyone found “spamming” by posting multiple
unrelated updates or comments that are unrelated to #NissanRogue or by sending
large numbers of duplicate @NissanCanada replies unrelated to the #NissanRogue
will be disqualified. By entering the Contest, entrants
agree to abide by and be bound by these Official Rules and Regulations (the “Official Rules”). The Sponsor and its employees, representatives
and agents are not responsible for any lost, late, misdirected, delayed and not
received (including failures due to transmission failures or technical failures of any
kind, including malfunctioning of any network, servers, access providers,
hardware or software, whether originating with sender or recipient), damaged, illegible, mechanically duplicated
or incomplete entries or any inaccurate transcription of entry information.
Proof of tweeting an entry is not proof of receipt by Sponsor. All entries
become the exclusive property of Sponsor and will not be acknowledged or
returned. Entries submitted in
accordance with these Official Rules shall be referred to hereafter as the “Eligible
Entries”. Entries must be received on or before 10:00:00 PM ET on February 14,
2014 (the “Contest Closing Date”).
If you use Twitter via a wireless
mobile device, standard text messaging and/or data rates may apply for each
message sent or received from your device. Other charges may also be applied by
your wireless carrier. Participation by wireless mobile device is not a
condition of entry.
5.
TWEETING FORMAT AND CONTENT:
- must be in English OR French;
- must be no more than 140 characters in length;
- must be relevant to each Question you are replying to posed on the @NissanCanada page and the Contest;
- must not, in the sole and unfettered discretion of the Contest Sponsor, contain any offensive, obscene, immoral or illegal depictions;
- must be intended for family audience viewing and contain only content that, in the sole and unfettered discretion of the Contest Sponsor, is suitable for all persons, including persons under the age of 13; and
- must be tweeted only once (cannot be retweeted).
6. PRIZE:
There
will be eight (8) prizes available to be won (herein referred to individually as “Prize” and collectively as “Prizes”).
i.
Grand Prize: There will be one (1) grand prize available to be won,
consisting of one (1) $250.00 (CDN) gas card (gas station to be determined at the sole discretion of the Sponsor) and a
collection of Nissan Promotional items (at the sole discretion of the Sponsor)
with an approximate retail value of $50.00 (CDN) (the “Grand
Prize”). The total approximate retail value of the Grand Prize
is $300.00 (CDN).
ii.
The Secondary
Prizes: There will be seven (7) secondary prizes available to be won, each consisting
of one (1) $50.00 gas card (gas
station to be determined at the sole discretion of the Sponsor) and a
collection of Nissan Promotional items (at the sole discretion of the
Sponsor) with an approximate retail
value of $50.00 (CDN)(a “Secondary Prize”). The total
approximate retail value of each secondary prize is $100.00 (CDN).
Each Gift Card may be used
towards a purchase at the participating gas station across Canada. See back of Gift
Card for details and restrictions. A
Gift Card has no cash surrender value and no expiry date. Any unused portion of
a Gift Card will remain on the Gift Card until the total value of the Gift Card
is used (for example: if a Gift Card is valued at $50 and $20 is used for the
first purchase, $30 will remain on the card and so forth until the total value
of the Gift Card is used). Prizes must be accepted as awarded without
substitution, are not transferable, not for resale and have no cash surrender
value. The Sponsor reserves the right, in the event that a Prize cannot be
awarded as described for any reason, to substitute another prize of equal or
greater value, without liability. Limit of one (1)
Prize per Person per Twitter Account during the Contest Period.
7. DRAW: One entrant will be
selected by random draw for each of the eight (8) Prize Periods from all
eligible entries applicable thereto (each a “Selected Entrant”) for the applicable Prize (see rule 6). The random draws will be performed in
Toronto, ON from among all eligible entries received by the Contest Closing
Date. Odds of being selected depend on the total number of Eligible Entries
received by the Contest Closing Date. In the event no Entries are received, the
Prize will not be awarded. The Contest Period is divided into the following eight (8) prize
periods (each a “Prize Period”). One draw will be made for each Prize Period
(the “Prize Period Draw”). The Prize
will be determined based on the Prize Period as described below. Entries received during a specific Prize
Period will be entered into the applicable Prize Period Draw.

The Sponsor will attempt to
contact the selected entrants by private message on Twitter within 24 hours of
being selected which will contain a URL link to a registration form. The
selected entrant must complete and submit the registration form with his/her
full name, contact information and correct answer to the skill testing question
within five (5) business days. To be declared a Prize Winner, a selected entrant must
correctly answer without assistance of any kind, whether mechanical or
otherwise, a mathematical skill testing question posed on the registration
form. By accepting and returning the registration form,
entrants are confirming that by entering the Contest, they are confirming compliance with these
Official Rules, certifying eligibility, confirming acceptance of the Prize as
awarded, without substitution, and releasing the Sponsor, the independent contest organization, their
affiliated and related companies, and their respective shareholders, directors,
officers, employees, agents, representatives, successors and assigns, and, if
applicable, their respective advertising or promotion agencies (collectively
the “Releasees”) from any liability in connection with the Contest and the Prize. If
a selected entrant (a) cannot be reached by reasonable efforts within five (5)
business days of being selected; (b) fails to correctly answer the mathematical
skill testing question (c) does not return the registration form properly
completed within the indicated time frame or (d) otherwise is not in compliance
with these Official Rules; then he/she will be disqualified and another entrant
will be randomly selected from among all remaining Eligible Entries until such
time as contact is made with the selected entrant or there are no more Eligible
Entries, whichever comes first. The Sponsor will not be responsible for failed
attempts to contact a selected entrant. The Prize will be delivered via courier
by the Sponsor to the confirmed winner at the address provided on the registration
form within four (4) to six (6) weeks of receipt by the Sponsor.
8.
GENERAL CONDITIONS: Entries received shall be deemed
to be submitted by the authorized account holder of the Twitter account
associated with the entry. For purposes of these Official Rules
"authorized account holder" is defined as the natural person who is
assigned to a Twitter account by Twitter. The winner may be required to provide
Contest Sponsor with proof he/she is the authorized account holder of the Twitter
account associated with the winning entry.
9. By entering the
Contest, you agree to the publication, reproduction and/or other use of your first
and last name, city of residence, statements or tweets about the Contest
without further notice or compensation, in any publicity or advertisement
carried out by the Contest Sponsor or its advertising and promotion agencies in
any manner whatsoever, including print, broadcast or on the Internet.
10.All entries
become the property of the Sponsor and shall in no case be acknowledged upon
receipt or returned to you. This Contest is subject to all applicable federal,
provincial, territorial and municipal laws and regulations. The decisions of
the Sponsor with respect to all aspects of this Contest are final and binding
on you without right of appeal, including, without limitation, any decisions
regarding the eligibility/disqualification of entries.
11.The Contest Sponsor and the Releasees assume no responsibility for
any error, omission, interruption, deletion, defect, delay in operation or
transmission, communications line failure, theft or destruction or unauthorized
access to, or alteration of, entries. Contest Sponsor and/or its agents are not
responsible for any problems or technical malfunction of any telephone network
or telephone lines, computer on-line systems, servers, or providers, computer
equipment, software, failure of any entry to be received by Contest Sponsor on
account of technical problems, human error or traffic congestion on the
Internet or at any Web site, or any combination thereof, including any damage
to participant’s or any other person’s computer and other property relating to
or resulting from participation in this Contest or from downloading any
materials in this Contest.
12.By entering the Contest, entrant agrees that Contest
Sponsor shall not be held responsible and that the entrant has no right to
bring (and covenants and agrees not to bring) any claim, action, or proceeding
of any kind or nature whatsoever against the Releasees in connection with this
Contest. By entering and/or accepting the Prize, entrants agrees to be bound by
these Official Rules and the Sponsor’s decisions and to release all Releasees
from any and all liability, loss or damage of any kind arising out of or in
connection with their participation in this Contest or with respect to
awarding, receipt, possession, use and/or misuse of a Prize or participation in
any Contest related activities.
13.The Contest Sponsor reserves the
right to terminate or amend this Contest at any time and in any way, without
prior notice. Without limiting the foregoing, if, for any reason, such as but
not limited to tampering, the Contest is not capable of running as originally
planned, the Contest Sponsor reserves the right, to cancel the Contest and
conduct a random draw from all previously received Eligible Entries received by the
time of cancellation.
14.PERSONAL INFORMATION: The
Sponsor respects your right to privacy. Personal information collected from
entrants will only be used by the Sponsor to administer
the Contest. For more information regarding the manner of collection,

15.In the event of any discrepancy or
inconsistency between the terms and conditions of these Official Rules and
disclosures or other statements contained in any Contest-related materials, including,
but not limited to point of sale, television, print or online advertising, the
terms and conditions of these Rules shall prevail, govern and control.
